TERMS OF
SERVICE
Effective August 31, 2026. These terms are the agreement between you and Dominic Baca d/b/a Workr. Read them before dispatching your first job — by creating an account, you agree to them.
WHO YOU'RE CONTRACTING WITH
Workr is operated by Dominic Baca d/b/a Workr, a sole proprietorship based in New Mexico. Throughout this document, "we" and "us" mean that party, and "you" means the operator who holds the account.
We say this plainly because you should know who you are dealing with: Workr is a small, independently run business, not a large company with a support department. That shapes what we can promise about availability and response times below, and we would rather you know it up front than discover it during an outage.
YOUR ACCOUNT
You must be 18 or older and legally permitted to operate the trade you register. You are responsible for everything that happens under your account, for keeping your credentials safe, and for the accuracy of what you enter.
One business per account. If you invite team members, you remain responsible for what they do in your workspace.
ACCEPTABLE USE
Do not use Workr to send unsolicited messages, to operate a fraudulent business, or to break any law that applies to your trade — including licensing, permits, insurance and tax obligations. Those obligations are yours, not ours.
We may suspend or decline service to any business that does. We will tell you why unless we are legally prevented from doing so.
SUBSCRIPTION, BILLING & REFUNDS
Paid plans bill monthly in advance through Stripe. Applicable taxes are added at checkout. Prices can change, but not mid-term — we will give you at least 30 days' notice before a change affects you, and you can cancel first.
You can cancel at any time from your settings. Your plan then stays active until the end of the period you have already paid for, and does not renew.
We do not refund the current or any past billing period. If something on our side is genuinely broken and we cannot fix it, contact us at support@myworkr.com — we would rather sort it out than hide behind this paragraph.
FREE PLAN & LIMITS
The free plan exists so you can decide whether Workr is worth paying for. It has usage limits, and paid features are marked in the product.
We may change what is included in the free plan. If a change would remove something you are actively relying on, we will give you notice and time to export your data or upgrade.
GETTING PAID BY YOUR CUSTOMERS
When your customers pay you through Workr, they are paying you, not us. You connect your own Stripe account, and that account is the merchant of record for every job you invoice. Money moves from your customer to your Stripe account. We never hold your funds.
This has consequences worth understanding before you rely on it:
- Your relationship with your customer is yours. The work, the price, the guarantee, and any dispute about them are between you and them. We are not a party to it.
- Chargebacks and disputes are handled by you and Stripe. Stripe's own terms govern that process. We do not mediate disputes, and we cannot reverse, release or recover a payment on your behalf.
- Stripe sets its own fees and payout timing, including how long a first payout takes and what identity verification it requires. Those are Stripe's decisions, not ours.
- You are responsible for your own taxes on money you receive, and for any refunds you agree to give your customers.
You will also need to accept Stripe's Connected Account Agreement. If Stripe suspends or closes your account, we cannot process payments for you, and that is outside our control.
TEXT MESSAGES & CONSENT
Workr can send SMS to your customers on your behalf, from a messaging number we operate. You are responsible for having permission to text every person you add.
Laws governing business text messages — in the United States, the Telephone Consumer Protection Act among others — carry real penalties, and they apply to you as the sender. Do not import a list of people who did not agree to hear from you. Honour opt-outs promptly; Workr records them, but the obligation is yours.
Because messages go out over shared messaging infrastructure, misuse by one operator can affect delivery for others. We may suspend messaging for an account that generates complaints.
YOUR DATA & YOUR CUSTOMERS' DATA
Your business data is yours. That includes your customer records, jobs, photos, voice memos and invoices. We do not sell it, and we do not use it to advertise to anyone.
We hold your customers' personal information on your behalf and act on your instructions with it. You decide what to collect and how long to keep it, and you are responsible for having a lawful reason to hold it.
You can export or delete your data at any time from settings. The Privacy Policy explains exactly what we collect, who it is shared with, and what happens when you delete an account.
AI FEATURES
Some features — voice-memo transcription and the dispatch assistant — send your content to an AI provider to process it. The Privacy Policy names which providers, and you can supply your own provider key in settings.
AI output can be wrong. Check anything that matters before acting on it. We are not liable for decisions made on the basis of a generated summary, transcript or suggestion.
AVAILABILITY
We work to keep Workr running, but we do not offer a guaranteed uptime level, and we do not provide 24/7 support. Maintenance, outages and third-party failures happen.
Because your work is in the field and ours is not, keep a way to operate if the app is unavailable. We are not liable for jobs missed during an outage.
WARRANTIES & LIABILITY
Workr is provided "as is" and "as available." To the fullest extent the law allows, we disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted, error-free, or that it will not lose data.
To the fullest extent the law allows, we are not liable for indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, lost revenue, lost business or lost data — even if we were told such damages were possible.
Our total liability for any and all claims relating to Workr is limited to the amount you actually paid us in the twelve months before the event that gave rise to the claim. If you are on the free plan, that amount is zero, and your remedy is to stop using the service.
Some jurisdictions do not allow certain exclusions or limitations, so parts of this section may not apply to you. Nothing here limits liability that cannot lawfully be limited — including for fraud.
CAP ON DAMAGES: FEES PAID IN THE PRIOR 12 MONTHS
INDEMNITY
You agree to cover us for claims, losses and reasonable legal costs arising from your use of Workr — in particular from the work you perform for your customers, messages you send them, data you collect about them, and any failure to meet an obligation that is yours under these terms.
SUSPENSION & TERMINATION
You can cancel anytime from settings. We may suspend or close an account for cause — fraud, abuse, non-payment, or a legal requirement.
After your account closes you have 30 days to export your data before it becomes eligible for deletion. If we close your account without cause, we will refund any unused prepaid time.
CHANGES TO THESE TERMS
We may update these terms. If a change materially reduces your rights, we will give you at least 30 days' notice by email or in the app before it takes effect.
Continuing to use Workr after that means you accept the new terms. If you do not, cancel before they take effect.
GOVERNING LAW
These terms are governed by the laws of the State of New Mexico, without regard to its conflict-of-law rules. Any dispute will be brought in the state or federal courts located in New Mexico, and both of us consent to that venue.
If any part of these terms is found unenforceable, the rest stays in force. These terms, together with the Privacy Policy, are the entire agreement between us about Workr.
